Your Agreement with Ashworth & Ingram Compensation Partners

Company Information

Ashworth & Ingram Compensation Partners Limited ("A&ICP"), The Old Mill, Kings Mill, Kings Mill Lane, Nutfield, Surrey RH1 5NB, is registered in England (Company No. 16196898) and regulated by the Financial Conduct Authority for Claims Management Activities (FRN: 1042169). We are registered with the Information Commissioner's Office (Registration No. ZB907311) (Us, Our, We).

This agreement is between Us and you, our customer (You, Your, I) in relation to your car finance claim.

What This Agreement Is For

When you sign this agreement:

  • We will represent you in your claim against car finance lenders who may have mis-sold finance to you
  • You agree to pay our fees on a No Win, No Fee basis (details in Section 6)

Your Claim Process

By signing, you authorise us to:

  • Make your claim and contact any third parties needed to manage it
  • Use the information you provide and process information we receive
  • Make professional decisions about how to proceed with your claim
  • Reach settlements on your behalf when we believe it's appropriate

Important Notice: You acknowledge you could make a complaint directly to the lender at no cost and, if dissatisfied, refer the matter to the Financial Ombudsman Service free of charge (subject to their eligibility criteria and time limits), or take matters to court if needed.

What We Need From You

To provide our service effectively, we need you to:

Information Requirements

  • Provide accurate and honest information about your circumstances and finance agreements
  • Share all relevant documents at the start of your claim, including emails and electronic files
  • Complete any forms or questionnaires we send you
  • Read and keep any documents we or the lender send you
  • Tell us immediately about any changes to your details or if you discover errors

Communication Requirements

  • Allow us to handle all communications with the lender once you've appointed us
  • Forward any correspondence sent directly to you by the lender within 7 days
  • Authorize lenders to pay compensation directly to us
  • Receive communications from us by email (unless legally required otherwise)
  • Not withdraw our authority with lenders without first cancelling this agreement

Our Commitment to You

We promise to:

  • Handle your claim with care and skill to maximize your chances of fair compensation
  • Help you complete necessary forms without "coaching" answers to inflate claims
  • Keep you updated throughout the process
  • Inform you if we believe your claim lacks sufficient merit and release you to pursue it independently if you wish
  • Decline or terminate claims where conflicts of interest may arise, explaining our reasons clearly

Our Fees - No Win, No Fee

We operate on a No Win, No Fee basis. This means:

  • You pay nothing if your claim is unsuccessful
  • Our fee is only payable if your claim succeeds and you receive compensation
  • Our fee includes any refund of loan capital, interest, charges, written-off debt, and interest on compensation

Important Points About Fees

Payment Process

  • We ask lenders to pay compensation directly to us; we'll deduct our fee and send you the balance within 48 business hours
  • If a lender pays you directly, you must tell us within 2 days and pay our invoice within 14 working days
  • For multiple claims, we may use cash from one successful claim to pay fees due on another with your authorization

Debt Write-offs

  • If your compensation includes debt write-offs rather than cash, our fee is still payable (you may need to pay from other sources)
  • E.g. if your £5,000 compensation consists entirely of written-off car loan payments you have not made to your lender, we would still be eligible for our fee of £1,680 that you'd need to pay from your own funds
  • In exceptional circumstances of significant financial hardship, we may consider extended payment terms in such situations

Your Right to Cancel

14-Day Cooling-Off Period

You have a 14-day cooling-off period after signing this agreement during which you can cancel without any charge. If you cancel during this period:

  • We'll stop all work on your claim
  • We'll notify lenders we're no longer representing you
  • You won't be charged for work already done

Cancellation After Cooling-Off Period

If you cancel after the 14-day cooling-off period:

  • If cancelled before a compensation offer: £250 + VAT fee per case
  • If cancelled after a compensation offer: Our success fee applies as outlined in Section 6
  • For multiple claims at different stages, each will be treated according to its status when you cancel

Payment Terms

  • Cancellation fees must be paid within 14 days of our invoice
  • If you're unable to pay immediately, please contact us to discuss payment arrangements

Breaching This Agreement

If you breach any clause in this agreement the following will apply:

  • We will notify You of what You have done to cause the breach and what needs to be done by You to fix it
  • We will give You a period of 14 days to carry out the actions needed in order to resolve it
  • If this is not going to be possible You must contact us so that We can agree a mutually suitable plan to allow Us to continue to represent you under this agreement

Consequences of Breach

If You fail to resolve the breach within the period specified above, We will deem this to be a cancellation of the agreement and as such cancellation fees will be payable in accordance with clause 7 of this agreement.

Your Personal Data

Data Usage

A&ICP take the privacy of Your personal information seriously. A&ICP will only use the personal information You provide to Us as outlined both in this clause 10 and in our Privacy Policy which can be viewed at www.ashworthingramcp.co.uk/privacy. A&ICP asks that you read our Privacy Policy carefully and, if required, a hard copy is available upon request.

During the Claims Services process Your personal information will be used to:

  • Provide the Claims Services
  • Tell You about similar products or services relating to financial claims, by email, SMS (text message), post and/or telephone, but You can opt out of receiving these, or a specific method of communication, at any time by contacting Us

Data Sharing

A&ICP will only provide Your personal information to a third-party organisation, with your explicit consent, except for the purposes of providing the Claim Services.

We will update You throughout Your Claim(s) by text, email and/or post.

Limitations of Liability

We shall not be liable for any costs or losses caused to You as a result of:

  • Delays caused by You in providing information or documentation requested by Us
  • Delays in the transmission or delivery of information or documentation caused by email service providers or the postal service
  • Claims settlement amounts later found to be lower than the maximum achievable
  • Failure of information or documentation sent between You and Us to arrive with the other party
  • Any other matter which is outside of Our control

Important Exceptions

This does not limit our liability for:

  • Negligence causing death or personal injury
  • Fraud or fraudulent misrepresentation
  • Failure to exercise reasonable care and skill
  • Any other liability that cannot be excluded by law

Before You sign this agreement, You must read the terms carefully. If there is anything that You do not understand in either document, you must ask Us for additional information or clarification before You sign this agreement.

Privacy Policy

You must also carefully read the Privacy Policy as displayed on Our website (www.ashworthingramcp.co.uk/privacy). This contains details of what We will do with your data, the consents You are giving by entering this agreement, and also Your rights under the Data Protection Act.

Data Processing Consent

If You do not understand any part of this document, you must ask Us for additional information or clarification before You sign the agreement. By signing this agreement, You agree to Your personal data being stored and processed in accordance with this policy.
